AML / CFT

LegalPath is required to obtain and verify information from prospective and existing clients under the Anti-Money Laundering and Countering Financing of Terrorism Act 2009 (AML/CFT) before commencing any work on any transaction. This requires us to collect certain information about Individuals and Entities related to your transaction.

The information we need to obtain from you and verify includes:

• Your full name, date of birth, and address, IRD Number and Citizenship.
  

• In the case of Companies or Trusts, the Directors, Shareholders, Trustees and Trust Beneficiaries will also need to provide this information.
  

• Information regarding any Entity associated with your property transaction i.e. if a Trust is involved, the Trust Deed will need to be provided together with company/trust IRD numbers.
  

• If you are purchasing, you will need to provide proof of where your money is coming from for the total purchase price. Source of Wealth/Source of Funds (SOW/SOF) evidence ensures that we have full disclosure of your financial sources. Should part of your financing be acquired through a gift, we will also need to complete CDD and SOW/SOF on the donor, unless they are able to provide this through their own lawyer. There will be an additional charge for any gift information that needs to be collected and we refer you to our fees page.

  
  

Once we have received your accepted quote and payment of your initial fee you will be provided with confirmation of your request. At this point Halliwells Lawyers Limited will review your service request and then provide instructions for verifying your ID and Proof of Address electronically and collecting Source of Wealth/Source of Funds information. Please note that this step is not automated and will be processed as soon as practically possible. Please allow time for this step as well as time for all information to be reviewed and signed off by our AML Compliance Officer.

We are unable to action any transaction without obtaining the required information from you. The more diligent you are at providing all required information in a timely manner the easier this process will be for you.
